Terms of Service

01 Acceptance of Terms

By downloading, installing, accessing, or using the PokéVault application ("App"), website ("Site"), or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and PokéVault Holdings ("PokéVault," "we," "us," or "our"). You must be at least 13 years of age to use the Service. If you are between 13 and 18 years old, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

02 Description of Service

PokéVault is a trading-card collection management platform that enables users to:

• Scan and identify trading cards using AI-powered image recognition
• Track collection value based on aggregated third-party market data
• Monitor price alerts and market movement for cards in their collection or watchlist
• Evaluate trade fairness using live market comparable data
• Export collection data in various formats including CSV, JSON, and PDF

PokéVault is not affiliated with, endorsed by, or sponsored by any trading-card publisher, manufacturer, or intellectual property owner. The Service is an independent tool for managing and valuing personal collections.

03 Accounts & Access

Account Creation

To access certain features, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Account Security

You agree to notify us immediately at hello@pokevaultapp.com if you suspect any unauthorized access to your account. We will not be liable for losses resulting from unauthorized use of your account where you have failed to keep your credentials secure.

Account Termination

You may delete your account at any time from within the App settings. Upon deletion, your personal data will be removed per our Privacy Policy. Collection data exports are available for 30 days following account deletion request.

04 Subscriptions & Billing

Subscription Tiers

PokéVault offers three subscription tiers:

• Hobbyist (Free): Core scanning and collection tracking with monthly scan limits. No credit card required.
• Collector ($59/month): Expanded scan limits, detailed AI grading, price alerts, trade checker access, and priority support.
• Vault ($99/month): Maximum scan allotments, unlimited price alerts, portfolio analytics, market trend predictions, and early feature access.

Billing Cycle

Paid subscriptions are billed monthly in advance. Your subscription automatically renews at the end of each billing period unless cancelled before the renewal date. Prices are displayed in USD and are exclusive of applicable taxes.

Cancellations & Refunds

You may cancel your subscription at any time through the App or App Store/Google Play subscription management. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. We do not offer prorated refunds for unused subscription periods, except where required by applicable law.

Price Changes

We may modify subscription prices with at least 30 days' advance notice via email or in-app notification. Continued use of the Service after a price change constitutes acceptance of the new pricing.

05 Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation
• Scrape, crawl, or harvest pricing data or user information from the Service through automated means
• Reverse engineer, decompile, or disassemble the App or any component of the Service
• Introduce malware, viruses, or other malicious code into the Service
• Attempt to gain unauthorized access to any system, network, or user account
• Use the Service for any fraudulent or deceptive purpose, including misrepresenting card condition or value in trades
• Resell or sublicense access to the Service without our express written consent
• Use the Service to infringe the intellectual property rights of any third party

Violation of these restrictions may result in immediate suspension or termination of your account without refund.

06 Intellectual Property

Our IP

The Service, including its software, design, text, graphics, logo, and AI models, is owned by PokéVault Holdings and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your personal, non-commercial purposes in accordance with these Terms.

Third-Party IP

Trading card names, set names, artwork, and associated trademarks are the property of their respective publishers and manufacturers. PokéVault uses card identification data for the purpose of collection management only and does not claim any rights in third-party intellectual property.

Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant PokéVault a royalty-free, worldwide, perpetual licence to use such feedback for any purpose without compensation to you.

07 User Content

You retain ownership of all content you submit or upload to the Service ("User Content"), including photographs of cards and collection metadata. By submitting User Content, you grant PokéVault a limited, worldwide, royalty-free licence to store, process, and display your User Content solely as necessary to provide the Service.

We do not use your personal collection data or card photographs for commercial advertising, sale to third parties, or AI model training without your explicit opt-in consent. Anonymized, aggregated market signal data may be used to improve the Service's pricing accuracy.

08 Pricing Data & Market Information

PokéVault aggregates sold-comparison data from multiple third-party marketplaces. We make reasonable efforts to ensure accuracy and freshness (data is typically refreshed every 15 minutes), but we cannot guarantee that displayed prices reflect current market conditions at any given moment.

Price data should not be used as the sole basis for significant financial decisions, insurance valuation, or legal proceedings. For formal appraisals, consult a certified card grading and appraisal professional.

PokéVault is not responsible for financial losses arising from decisions made based on in-app price data.

09 Vault Tier Additional Terms

Subscribers to the Vault tier ("Vault Subscribers") have access to additional features including portfolio analytics and market trend predictions. The following additional terms apply:

Market Trend Predictions

Market trend predictions are generated by algorithmic models and are speculative in nature. Past price performance does not guarantee future results. PokéVault expressly disclaims liability for investment decisions made in reliance on prediction features.

Early Access Features

Vault Subscribers may receive access to features that are still in development. Early access features may be modified, discontinued, or changed without notice. We will endeavour to notify Vault Subscribers of significant changes.

Portfolio Analytics

Portfolio analytics reports are generated from your collection data and market pricing data. These reports are provided for personal tracking purposes only and do not constitute financial statements or certified appraisals.

10 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POKÉVAULT DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or available at all times
• Card identification results will be 100% accurate in all cases
• Pricing data will be complete, accurate, or current at any given time
• The Service will meet your specific requirements

11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POKÉVAULT HOLDINGS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In jurisdictions that do not allow the exclusion or limitation of certain damages, PokéVault's liability is limited to the greater of (a) the amount you paid for the Service in the 12 months preceding the claim, or (b) $100 USD.

12 Indemnification

You agree to indemnify, defend, and hold harmless PokéVault Holdings and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from:

• Your violation of these Terms
• Your User Content
• Your violation of any applicable law or the rights of any third party
• Your use of the Service in an unauthorized manner

13 Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

If your account is terminated due to our breach of these Terms, you are entitled to a prorated refund for the unused portion of any prepaid subscription period.

14 Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association. Class action waivers apply to the extent permitted by law.

15 Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and/or via an in-app notice at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of updated Terms constitutes acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service before the effective date.
